GENERAL CONDUCT
Customers are prohibited from transmitting on or through any of Highland Web Search's services, any material that is, in Highland Web Search sole discretion, unlawful, indecent, threatening, abusive, libelous, or encourages conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any local, national or international law, statute or regulation.
Highland Web Search services may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of UK regulation or law is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute. Highland Web Search reserves the right to remove such illegal material from its servers.
Clients may not engage in delictual, (tortuous) conduct including, but not limited to, posting of defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or making physical threats against another person via email, news, or any other electronic media/service we provide.
The Customer is responsible for providing and maintaining accurate and up-to-date billing information. Furnishing false data on the signup form, contract, or online application, including fraudulent use of credit card numbers, are grounds for immediate termination, and may subject the offender to civil or criminal liability.
CANCELLATION
You hereby agree to Highland Web Search canceling any contract that stands between you the CLIENT and Highland Web Search if:
You the CLIENT breach the terms of payment in any way.
You the CLIENT are the subject of a receiving order in bankruptcy (or in Scotland
sequestration).
You the CLIENT give or lead to giving any untrue or false information which
is to be displayed on the Highland Web Search site and/or leads to access to
any part of the internet without the full knowledge of the User knowing where
he or she is going or accessing.
You the CLIENT provide any form of link or address to any form of pornographic
or offensive material.
You the CLIENT fail to observe, follow or perform any of the terms or conditions
of the contract.
COPYRIGHT
Except where otherwise noted or stated, the content of Highland Web Search, highlandwebsearch.co.uk. Highlandwebsearch.com Highland Web Search (any and all of its designs, graphics, text, logos and arrangements thereof) and any software therein is the property of and owned by Highland Web Search and are all protected by Trademark and copyright laws.
Please note that any other Trademark or copyrights found or sourced either on or via Highland Web Search are from other CLIENTS and Highland Web Search do not hold any responsibility in any way, shape or form for their usage.
APPLICATION OF CONDITIONS OF USE
By using, accessing or subscribing to Highland Web Search you agree to be bound by its Terms & Conditions. If you do not agree to all of its Terms & Conditions please do not use or access Highland Web Search.
We may, at any time, change any of the Terms & Conditions without giving prior notice. It is therefore the responsibility of both the CLIENT and the USER to check these Terms & Conditions on a regular basis for any updates or amendments to the Terms & Conditions.
PERMITTED USES
No materials of Highland Web Search or any other part of Davcam may be copied, reproduced, broadcast, downloaded, shown or played in public, uploaded, stored, posted, transmitted, distributed, changed or be adapted in any shape or form.

DISCLAIMER
The site shall offer its services free of charge to organisations that Highland Web Search deem reasonable such as Local Councils, Hospitals, Police, Emergency numbers, child line, The Samaritans and other charitable organisations.
Although Highland Web Search will do its utmost to ensure that all information that can be accessed on the site is correct, Highland Web Search do not guarantee this.
All information is supplied and verified by you the CLIENT and therefore Highland Web Search does not take or hold any responsibility of the any of the contents that is held or can be accesses through its site by a USER.
Davcam, Highland Web Search or any of its owners, employees, third party operators, affiliates sponsors or the likes, do not make any representation, warranty or condition in any form to you that:

USER TERMS AND CONDITIONS
Any member of the public (which will be known as a USER in this document) is entitled free of charge use Highland Web Search as long as he or she adhere to the terms and conditions set out in this document.
NOTICE
Although Highland Web Search is under no obligation to notify its CLIENTS of any changes it makes to the web site or terms and conditions Highland Web Search will from time to time notify you of information via the information page of the web site. It is therefore the responsibility of the CLIENT to ensure they check the information page on regular basis.
DATA PROTECTION
All information that is supplied to Highland Web Search is treated as strictly confidential and will not be passed on to any other organisation without the prior permission of the CLIENT. Highland Web Search only stores information on its database and back up facilities. Under the laws of the Data Protection Act 1998 Any CLIENT has the right to request any information that we hold either on paper or computer. If any CLIENT would like this information please put this in writing with a self addressed envelope. Please note that Highland Web Search offer this service free.
Highland Web Search will not sell or knowingly disclose its customer lists or customer email or listserve address lists. We will attempt to protect the privacy of our Customers and their information that is stored on our network. Highland Web Search will only access and disclose information as necessary to comply with applicable laws and governmental requests, to operate and maintain our systems and services, or to protect ourselves or our Clients.
UPDATE INFORMATION
The importance of accurate and updated information is critical. It is the responsibility of the CLIENT to ensure that any changes to the CLENTS business are forwarded to Highland Web Search to ensure that all information is as accurate as possible at all times. As a safety net Highland Web Search will, at the start of each full years term email the CLIENT requesting any updated information, it is the responsibility of the CLIENT to ensure that this information is returned for updating the web site.
MISCELLANEOUS
This Agreement sets forth the entire agreement between Highland Web Search and the Customer with respect to the subject matter hereof and supersedes all previous representations. If any provision of this Agreement is held to be invalid by a court of competent jurisdiction, then the remaining provisions shall nevertheless continue in full force and effect. The Customer may not transfer or assign this Agreement without prior written consent from Highland Web Search. The laws of Scotland shall govern this Agreement and all claims concerning this Agreement shall be brought exclusively in courts located in Scotland. The parties hereby consent to submit to the jurisdiction of such courts and waive any personal jurisdiction or venue defences concerning said forum. The Customer is deemed to have agreed to this Agreement, when commencing use of any of Highland Web Search's services.
